1. Acceptance of Terms
By accessing masadir.net, utilizing our APIs, or subscribing to our services, you enter into a legally binding agreement with MASADIR ECONOMICS. Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. If you are using these services on behalf of an organization, you represent that you have the legal authority to bind that entity to these terms.

2. Data License & Proprietary Rights

  • Limited License: We grant you a non-exclusive, non-transferable, revocable license to fetch and display our data within your specific application or platform for internal business use.
  • Ownership: All data provided through the API (including Gold and Silver spot prices) remains the intellectual property of Masadir.net and its data providers.
  • Strict Anti-Redistribution: You may not resell, sub-license, redistribute, or republish our raw data feeds to third parties. You may not use our data to create a competing API, data service, or financial index.

3. API Security & Key Management

  • Confidentiality: Your API key is your digital signature. You are fully responsible for all activities that occur under your key.
  • Liability for Misuse: Any requests made using your key will be billed to your account. Masadir is not liable for losses resulting from stolen keys.
  • Breach Protocol: You must regenerate your key immediately via the dashboard if you suspect a breach.

4. Billing, Renewals, and Refunds

  • No Refunds: All payments are non-refundable. We do not provide pro-rated refunds for partial months or unused quotas.
  • Auto-Renewal: Paid plans auto-renew each billing cycle (Monthly/Yearly) unless cancelled 24 hours prior to the renewal date.
  • Overage Charges: Exceeding your plan's request limits may result in service throttling or automatic overage charges as defined in your plan details.

5. Acceptable Use & Restrictions

  • No Scraping: Use of bots, scrapers, or spiders to extract data from the website is strictly prohibited. Access is permitted only via the documented API endpoints.
  • No Pooling: You may not bypass rate limits by creating multiple free accounts or pooling requests across multiple keys.
  • No Illegal Use: You may not use the service for any unlawful purpose, including market manipulation or fraud.

6. Technical Limitations & Comprehensive Disclaimer

6.1 Service Provided "As-Is"
The service and data are provided on an "as is" and "as available" basis. Masadir Economics expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Third-Party Dependencies
Masadir.net operates as a data aggregator. You acknowledge that the service depends on third-party providers (exchanges, liquidity providers, cloud hosts). We are not liable for interruptions caused by:

  • Hosting & Cloud Failures: Disruptions in server uptime provided by our cloud infrastructure partners (e.g., AWS, Google Cloud, or Azure).
  • Upstream Data Source Issues: Delays, errors, or “freezes” in data feeds originating from liquidity providers, global exchanges, or bullion banks.

6.3 System Latency & “Slippage”
Financial data transmission is subject to network latency. We do not guarantee that the price displayed via API is the exact executable price in the live market at that microsecond. Masadir.net is not responsible for "financial slippage," trading losses, or missed opportunities.

6.4 Force Majeure
Masadir.net is excused from any performance failure caused by conditions beyond its reasonable control, including natural disasters, war, cyber warfare (DDoS), or widespread utility failures.

Masadir provides aggregated market data from publicly available sources. All data is for informational purposes only and may not match official exchange records.

7. Limitation of Liability

7.1 Cap on Liability
To the maximum extent permitted by law, the total liability of Masadir Economics, its directors, employees, or partners, for any claim arising out of or relating to these terms or the use of the service, shall not exceed the amount you paid to us for the service in the twelve (12) months preceding the event giving rise to the claim.

7.2 No Consequential Damages
In no event shall Masadir Economics be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, or trading losses.

7. Market Data Attribution

Market data displayed on Masadir.net is aggregated from publicly available sources, exchange disclosures, and third-party information providers. Masadir Economics does not claim ownership of underlying market data and does not represent itself as an official data source for any exchange.

Displayed prices and indicators are intended to provide a general market overview and may differ from official exchange data or licensed real-time feeds.

Certain instruments, including some index, energy, futures, foreign exchange, and commodity references, may be sourced from public or delayed third-party feeds such as Yahoo Finance and similar market data publishers. Where such sources are used, the data is provided for informational display, monitoring, editorial, and general market-overview purposes only, and must not be relied upon as an official exchange record, settlement price, or guaranteed real-time executable quote.

Operational fields such as market-session status, session open, session close, and similar availability indicators are generated from Masadir's internal scheduling model for monitoring and display consistency. They are not official exchange notices and must not be interpreted as authoritative exchange session definitions.

8. Indemnification

You agree to indemnify, defend, and hold harmless Masadir Economics and its affiliates from and against any and all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with:

  • Your access to or use of the Service and API;
  • Your violation of these Terms;
  • Any products or services you build using our data.

9. Termination

We reserve the right to suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

10. Governing Law

These terms are governed by the laws of the United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.

11. Security Violations & Injection Attempts

If any user, subscriber, or guest attempts to inject malicious code, exploit vulnerabilities, or engage in suspicious activity targeting the system's integrity, Masadir Economics will immediately take the following procedures:

  1. Immediate Termination: We will permanently suspend the account and block the IP address involved without prior warning.
  2. Legal Prosecution: We reserve the right to report the incident to cybercrime authorities and pursue full legal recourse for damages.
  3. Global Blacklisting: The user's credentials will be added to security blacklists to prevent future access to our services.

12. Usage Monitoring & Audit Logs

You acknowledge and agree that Masadir Economics logs all API requests, including but not limited to IP addresses, request timestamps, user agents, and accessed endpoints. This data is recorded internally for:

  • Billing & Quota Management: To accurately calculate usage and enforce rate limits.
  • Security & Auditing: To detect suspicious patterns, prevent abuse, and protect the platform.
  • Statistical Analysis: To improve service performance and optimize infrastructure.

13. Modifications to Terms

Masadir Economics reserves the right to modify these Terms at any time. We will notify users of significant changes via email or a dashboard notice. Continued use of the API after such changes constitutes your acceptance of the new Terms.

14. General Provisions

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Entire Agreement: These Terms constitute the entire agreement between you and Masadir Economics regarding the Service.
  • No Waiver: Failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
